End User License Agreement

This End User License Agreement ("EULA") is a legal agreement between you ("Licensee") and Arturo Canuelas ("Licensor"). By downloading, installing, accessing, or using the Zelfie AI application — whether on iOS, Android, or web (the "Application") — you agree to be bound by this EULA. If you do not agree, do not install or use the Application.

Subject to your compliance with this EULA and our Terms of Service, Licensor grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to:

• Install and use the Application on devices that you own or control, solely for your personal or internal business use to create content with the Zelfie AI service.
• For iOS users, the license is granted in accordance with the Usage Rules set forth in Apple's Media Services Terms and Conditions (i.e., the App may be used on any device you own or control, subject to Family Sharing limits).

You may NOT, and you may not permit any third party to:

• Copy, modify, adapt, translate, or create derivative works of the Application;
• Reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Application, except where this restriction is expressly prohibited by applicable law;
• Remove, alter, or obscure any proprietary notices (including copyright and trademark notices);
• Distribute, sublicense, rent, lease, lend, sell, transfer, or assign the Application or any rights under this EULA;
• Use the Application or its outputs to train, fine-tune, or evaluate any machine-learning or generative AI system;
• Use the Application to build a competing product or service;
• Use the Application in a way that violates any applicable law or the rights of any third party.

The Application is licensed, not sold. Licensor and its licensors retain all right, title, and interest in and to the Application, including all intellectual-property rights. This EULA does not grant you any rights to the Zelfie AI trademarks, the Z mark logo, or any other brand element of Licensor.

Licensor may, at its discretion, provide updates, upgrades, patches, or bug fixes for the Application. Such updates may be automatic and may modify or remove features. This EULA governs any such updates unless they are accompanied by a separate license.

The Application uses third-party services to function, including but not limited to: cloud hosting (Vercel, Modal), database and authentication (Supabase), AI inference (OpenAI, Anthropic, etc.), speech transcription (Whisper / ElevenLabs), and payment processing (Stripe, Apple, Google). Your use of these third-party services is subject to their respective terms.

For users who download the Application via the Apple App Store:

• Acknowledgment. This EULA is between you and Licensor only, not with Apple. Apple is not responsible for the Application or its content.
• Scope of license. The license is non-transferable and limited to use on Apple-branded products you own or control, as permitted by the Usage Rules of the Apple Media Services Terms.
• Maintenance and support. Licensor (not Apple) is solely responsible for providing any maintenance and support for the Application.
• Warranty. Licensor (not Apple) is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, for the Application to you. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the Application.
• Product claims. Licensor, not Apple, is responsible for addressing any claims relating to the Application, including: (i) product liability claims, (ii) any claim that the Application fails to conform to any legal or regulatory requirement, and (iii) claims arising under consumer protection, privacy, or similar legislation.
• IP claims. In the event of any third-party claim that the Application or your possession and use of the Application infringes that third party's intellectual-property rights, Licensor (not Apple) is solely responsible for the investigation, defense, settlement, and discharge of any such claim.
• Legal compliance. You represent and warrant that (i) you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
• Third-party beneficiary. Apple, and Apple's subsidiaries, are third-party beneficiaries of this EULA. Upon your acceptance of the EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce the EULA against you as a third-party beneficiary.

For users who download the Application via Google Play, the Application is also subject to the Google Play Terms of Service.

THE APPLICATION IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. LICENSOR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LICENSOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE APPLICATION.

This EULA is effective until terminated. Your rights under this EULA terminate automatically without notice if you fail to comply with any term. Upon termination, you must cease all use and destroy all copies of the Application in your possession.

This EULA is governed by the laws of Puerto Rico, United States, without regard to conflict-of-laws principles, except as required by mandatory consumer-protection law in your country of residence.
